Use of Services

Duvelt provides proprietary trading automation technology, tools, and related services designed to assist users in accessing financial markets. Duvelt does not provide investment advice, financial advice, portfolio management, or guarantees of performance. All Services are provided for informational, educational, and technology-access purposes only. You are solely responsible for all decisions made using the Services.

Trading Risk & No Guarantees

By using Duvelt, you acknowledge and agree that:

Trading financial instruments involves substantial risk, including the potential loss of capital
Past performance is not indicative of future results
Duvelt does not guarantee profits, returns, or specific financial outcomes
Results depend on market conditions, account configuration, capital, and external factors beyond Duvelt’s control
Any Money-Back Guarantee offered by Duvelt applies only under specific conditions and is based on defined performance criteria. It does not constitute a guarantee of trading performance or financial results.

Account Ownership & Responsibility

You retain full ownership and control of your brokerage account at all times
Duvelt does not custody, control, or withdraw funds from your brokerage account
All trading activity occurs within your own account and at your sole risk

Plans & Program Eligibility

Duvelt offers subscription-based plans designed primarily for individual traders operating within typical retail capital ranges.

If a user deploys the Duvelt system on an account exceeding a capital threshold determined by Duvelt (for example $100,000 or greater in trading capital), Duvelt may require transition to an alternative program such as the Inner Circle Program or other advanced service tiers. These programs may include different pricing structures, performance-based fees, or customized service terms appropriate for larger accounts.

Duvelt reserves the right, at its sole discretion, to modify, restrict, suspend, or discontinue subscription-based access for accounts exceeding this threshold if the user chooses not to transition to the applicable program.

Duvelt may evaluate eligibility based on the aggregate capital deployed across multiple accounts or accounts reasonably believed to be controlled by the same user.

Participation in advanced programs may include additional oversight, customized configuration guidance, and capital-specific risk frameworks designed to support larger trading accounts. Participation in such programs does not constitute investment advice, portfolio management, or discretionary trading authority.

Account Monitoring & Performance Tracking

Duvelt may monitor and review account activity and performance data.

This may include:

Trade history
Account balance and equity
System usage and configuration
Monitoring is used solely for:
Evaluating system performance
Verifying compliance with usage requirements
Providing support and operational oversight

All monitoring is limited to read-only access or equivalent permissions. Duvelt does not execute trades, withdraw funds, or control user accounts.

You are responsible for granting and maintaining any necessary access required for monitoring. Duvelt does not access accounts without user authorization.

Failure to provide or maintain required access may result in loss of eligibility for the Money-Back Guarantee.

By using the Services, you consent to this monitoring.

Profit Share & Billing

If you enroll in the Inner Circle Programs or other advanced service tiers, you agree that:

Profit share is calculated based on gross realized profits only, defined as closed and realized profitable trades during the applicable billing period
Unrealized losses, open trades, floating P&L, or drawdowns are not deducted from gross realized profits
You authorize Duvelt to charge the credit card on file for any applicable upfront licensing fees and monthly profit-share fees, billed at the end of each calendar month
Failed payments may result in immediate suspension or termination of bot access

Money-Back Guarantee

Duvelt offers a conditional Money-Back Guarantee designed to align with long-term system performance.

The system is designed to generate consistent monthly cashflow over time when used correctly. However, due to the nature of financial markets, performance is evaluated over a longer-term period rather than individual months.

indirect losses, damages, or claims arising from your use of our platform, including but not limited to trading losses, data inaccuracies, or technical issues.

Eligibility Requirements

To qualify for the Money-Back Guarantee, you must:

Maintain continuous use of the Services for a minimum of 12 months
Not cancel, pause, or interrupt usage during this period
Follow all system setup, configuration, and risk management guidelines
Not manually trade or interfere with system operation
Maintain a minimum account balance of $20,000
Failure to meet any of the above conditions will result in disqualification from the guarantee.

Performance Evaluation

Performance is tracked on a monthly basis
Evaluation is based on total performance over the full 12-month period
Individual monthly results do not determine eligibility

Net Cashflow Definition

Net Cashflow is defined as:

Total Realized Profit − Total Costs

Costs include:

Subscription fees
Upfront program fees
Performance-based (profit share) fees
Brokerage fees (commissions, spreads, swaps)
Realized losses

Unrealized (floating) profit or loss is not included.

Refund Eligibility

You may be eligible for a refund if:

All eligibility requirements are met
Net Cashflow over the 12-month period is not positive

If total realized profit exceeds total costs, the guarantee is considered fulfilled.

Refund Scope

If eligible:

Subscription fees paid during the evaluation period may be refunded
Upfront program fees may be refunded
The following are non-refundable:
Performance-based (profit share) fees
Trading losses
Brokerage or third-party costs

Important

Early cancellation or interruption of service will result in immediate loss of eligibility for the Money-Back Guarantee.

Payment of performance-based fees may be considered evidence of positive system performance and may impact eligibility.

Cancellation

Services are provided on a month-to-month basis
You may cancel at any time
Upon cancellation, Services remain active through the end of the current billing month
The final profit-share charge will be processed at month-end
Refunds are only provided where explicitly stated under the Money-Back Guarantee

Early Access & Beta Participation

Users who opt into early access or beta features understand that these tools may be experimental and subject to change. Performance data during early access may not reflect final product outcomes. We appreciate your feedback as we continue improving the platform.

Pricing Changes

Duvelt reserves the right to update pricing, fees, or profit-share percentages from time to time:

Any changes apply prospectively only
Changes take effect at the start of the next billing period after notice
Continued use of the Services after changes take effect constitutes acceptance
If you do not agree to updated terms, you may cancel prior to the effective date.

Communications

By signing up, you consent to receive SMS messages, emails, and calls from Duvelt related to early access, platform updates, and other relevant content. Message and data rates may apply. You can unsubscribe at any time by replying “STOP” or using the unsubscribe link provided.

Intellectual Property

All content, branding, and software associated with Duvelt is the intellectual property of Duvelt or its licensors. You may not copy, distribute, or modify any materials without written consent.

Limitation of Liability

Duvelt and its affiliates shall not be held liable for any direct or indirect losses, damages, or claims arising from your use of our platform, including but not limited to trading losses, data inaccuracies, or technical issues.

Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Continued use of our Services after changes are posted constitutes acceptance of those changes.
